We use various outsourced business partners for digital projects, couriers, accountancy and IT services and they act in the capacity of a processor on our behalf. The only information we provide them with is your name, address, and order details to meet business and legal requirements.

Evolve Flowers Ltd uses third-parties to provide additional services and business functions; however, all processors acting on our behalf only process your data in accordance with instructions from us and comply fully with this privacy notice, the data protection laws and any other appropriate confidentiality and security measures.

Evolve Flowers Ltd takes your privacy seriously and takes every reasonable measure and precaution to protect and secure your personal data. We work hard to protect you and your information from unauthorised access, alteration, disclosure, or destruction and have several layers of security measures in place, including:

• We enforce strong password requirements and regular password change policies for user authentication

• We protect your data in transit to your web browser using SSL/TLS encryption

What are the consequences of not providing my data?

You are not obligated to provide your personal information to Evolve Flowers Ltd, however, as this information is required for us to provide you with our services/deliver your products/legitimate interests, we will not be able to offer some/all our services without it.

How long do we keep your data?

only ever retains personal information for as long as is necessary and we have strict review and retention policies in place to meet these obligations. We are required under UK tax law to keep your basic personal data (name, address, contact details) for a minimum of 6 years after which time it will be destroyed. Where you have consented to us using your details for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent.

Will you send me marketing mailshots?

We like to keep you informed of promotions and new products; these are generally posted in the Trade-Evolve Flowers Facebook group. Occasionally, Evolve Flowers Ltd would like to contact you with the exclusive promotional offers that we provide. If you consent to us using your contact details for this purpose, you have the right to modify or withdraw your consent at any time by using the opt-out/unsubscribe options or by contacting Evolve Flowers Ltd directly.

Legitimate Interests

Evolve Flowers Ltd will occasionally send you promotions by email that have been identified as being beneficial to our customers and in our interests. Such information will be relevant to you as a customer and is non-intrusive and you will always have the option to opt-out/unsubscribe at any time.

Lodging A Complaint

Evolve Flowers Ltd only processes your personal information in compliance with this privacy notice and in accordance with the relevant data protection laws. If, however you wish to raise a complaint regarding the processing of your personal data or are unsatisfied with how we have handled your information, you have the right to lodge a complaint with the supervisory authority. Evolve Flowers Ltd take your privacy seriously and will only process your personal data with your consent and in accordance with the terms stated in our Privacy Notice.

Third-Party Couriers

Please understand that couriers are out of our control and if you have an issue with delivery it is best to contact the courier directly. We will of course try to assist with any courier related issues however it is with discretion that we refund for transit damage or loss. If our perishable products are lost or damaged in transit they are not refunded by couriers. We can assure you we make every effort to package our items effectively to reduce any damage in transit.

 

 Wholesale Terms & Conditions: Perishable Goods (Flowers)

1. Nature of Goods
All fresh flowers and foliage supplied by Evolve Flowers Ltd are classed as perishable goods under the Consumer Contracts Regulations and Consumer Rights Act 2015. As such, standard return and cancellation rights do not apply once an order has been fulfilled.

2. Quality & Inspection
We take every care to ensure that our flowers are of high quality and are packed to arrive in optimal condition. Due to the perishable and natural nature of our product, variations in colour, size, and maturity may occur. These are not considered faults.

3. Risk & Responsibility
Once goods have been dispatched from our premises, risk and responsibility pass to the buyer. It is the buyer’s responsibility to inspect all flowers upon receipt and report any issues within 12 hours of delivery with clear photographic evidence of each problem stem laid out.

4. No Guarantee on Longevity
Fresh flowers are living products and their vase life is subject to handling, storage, temperature, and variety. We do not accept responsibility for reduced vase life once the flowers have left our control.

5. Returns & Refunds
Due to the nature of fresh flowers, we do not accept returns. Refunds or partial credit may be issued at our discretion only in cases of proven product damage or failure, reported within the above timeframe.

6. Substitutions
In the event that a particular flower is unavailable, we reserve the right to substitute with a similar product of equal or greater value, suitable for professional use.

Delivery & Refunds (B2B)
1. Delivery
We will use all reasonable endeavours to deliver the Goods on the agreed delivery date. Delivery dates are given in good faith but are estimates only and time for delivery shall not be of the essence unless expressly agreed in writing. Risk in the Goods passes to the Buyer on delivery to the agreed address or to the carrier acting on the Buyer’s behalf.
2. Inspection and Notification
The Buyer shall inspect the Goods immediately upon receipt. Any claim for loss, damage, shortage or late delivery must be notified to us in writing within 24 hours of receipt (or, in the case of non-delivery, within 3 days of the expected delivery date). Such claim must include reasonable evidence of the alleged defect, damage or delay (including photographs of the Goods on arrival and relevant delivery notes or courier tracking).
3. Remedies
Where the Buyer establishes to our reasonable satisfaction that the Goods are defective, damaged or delivered late in breach of this Agreement, we may at our option:
  • (a) replace the Goods (or the defective part), or
  • (b) issue a credit note or refund of the price paid for the Goods (or a proportionate part of it).
This shall be the Buyer’s sole remedy for such breach.
4. Limitation of Liability
Except as expressly provided in this Agreement, we shall not be liable for any indirect or consequential loss (including loss of profit, loss of business or loss of goodwill) arising out of late delivery, non-delivery or defects in the Goods. Our total liability under or in connection with any order shall not exceed the price of the Goods supplied under that order.
